These Terms of Use (“Terms“) govern your access to and use of RealHodge.com (the “Site“) operated by Real Hodge Group (“we,” “us,” or “our“). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.
Please read carefully — Section 10 limits our liability and Section 12 contains an arbitration agreement and class-action waiver that affect your legal rights.
1. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use the Site. If you use the Site on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. The Site Is Informational
The Site provides real estate information, listing search, market insights, and contact tools. The Site is not a substitute for professional real estate, legal, tax, or financial advice. Before making any real estate decision, consult a licensed professional.
We are a Florida-licensed real estate brokerage. Our broker license number is CQ1073355. Nothing on the Site creates a brokerage relationship between you and Real Hodge Group; a brokerage relationship exists only when established in writing as required by Florida law.
3. Property Listings and IDX Data
Listing information on the Site comes from the Multiple Listing Service (“MLS“) through the Bridge Data Output / Miami Association of Realtors RESO API.
You should treat all listing information as informational only. Specifically:
- Listings may not be current. Properties may have been sold, withdrawn, or had their price changed without immediate update.
- Square footage, lot size, room count, school assignments, taxes, HOA fees, and similar details are provided by the listing agent and are not independently verified by us. Buyers should verify any detail that is important to their decision.
- Photographs may be staged, virtually staged, or out-of-date.
- Community market insights, price ranges, comparable sales, and neighborhood information are estimates derived from public and licensed data and are not appraisals.
- Home value estimates we provide are computer-generated estimates based on comparable sales data and are not appraisals or offers to purchase. Actual market value can differ significantly.
- School assignment data is provided as a courtesy and changes over time. Confirm school assignments directly with the school district.
The MLS retains all rights in MLS data displayed on the Site. We use it under license.
4. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Use any automated means (including scraping, crawling, harvesting, or bots) to access, copy, or extract data from the Site, except for public search engines obeying our robots.txt file
- Copy, reproduce, distribute, sell, lease, or commercially exploit any content from the Site without our prior written permission
- Reverse engineer, decompile, or attempt to derive the source code of the Site or any of its components
- Bypass, disable, or interfere with security or access-control features of the Site
- Submit false, misleading, or fraudulent information, including using another person’s identity
- Upload, send, or transmit any virus, malware, or harmful code
- Send unsolicited commercial messages to any contact obtained through the Site
- Use the Site to harass, abuse, defame, or stalk any person
- Interfere with the operation of the Site or any other user’s use of the Site
We may suspend or terminate your access at any time for any reason, including violation of these Terms.
5. Intellectual Property
The Site, including its design, layout, code, logos, trademarks, text, photos, graphics, and other content (other than MLS data and third-party content) is owned by Real Hodge Group or our licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use only. All rights not expressly granted are reserved.
The “Real Hodge Group,” “Real Hodge,” and “Hodge Group” names and logos are trademarks of Real Hodge Group. You may not use them without our prior written consent.
6. User Submissions
If you send us inquiries, messages, photos, reviews, or other content (“User Submissions“), you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, copy, modify, display, and distribute your User Submissions in connection with operating and promoting the Site and our business. You represent that you have the right to grant this license and that your User Submissions do not infringe anyone’s rights or violate any law.
We do not have to treat User Submissions as confidential and we are not responsible for storing them.
7. Third-Party Links and Services
The Site links to and integrates with third-party services, including Google (Sign in, Maps, Places, Analytics, Ads), Meta (advertising pixels), Bridge / Miami Association of Realtors, Follow Up Boss, DotLoop, Cloudflare, our email service provider (such as Mailchimp, SendGrid, or Mailgun), showing-coordination services such as ShowingTime or Showami, scheduling and meeting tools such as Zoom and Calendly, MoneyCorp, and others. We are not responsible for the content, accuracy, terms, or privacy practices of third-party services. Your use of those services is governed by their own terms.
8. Fair Housing and Equal Opportunity
Real Hodge Group complies with the Fair Housing Act, the Florida Fair Housing Act, and all applicable equal opportunity laws. We do not discriminate on the basis of race, color, religion, national origin, sex, disability, familial status, sexual orientation, gender identity, or any other protected characteristic. 9. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND. To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, and availability.
We do not warrant that the Site will be uninterrupted, error-free, or secure, that defects will be corrected, or that the Site or its servers are free of viruses or other harmful components.
We do not warrant the accuracy, completeness, or current status of any listing, market data, school information, or any other information on the Site.
10. Limitation of Liability
To the fullest extent allowed by law, Real Hodge Group and its officers, agents, employees, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for all claims arising out of or related to the Site or these Terms will not exceed one hundred dollars ($100) or the amount you paid us in the prior twelve months, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
11. Indemnification
You agree to defend, indemnify, and hold harmless Real Hodge Group and its officers, agents, employees, and licensors from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys’ fees) arising out of (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any User Submission you make.
12. Governing Law, Disputes, and Arbitration
12.1 Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. The federal and state courts located in Miami-Dade County, Florida have exclusive jurisdiction over any dispute not subject to arbitration.
12.2 Informal Resolution First
Before filing a claim, you agree to try to resolve the dispute informally by emailing info@realhodge.com with a description of the dispute. We will try to resolve the matter within 60 days.
12.3 Binding Arbitration
If informal resolution does not resolve the dispute within 60 days, you and Real Hodge Group agree to resolve any claim through final and binding arbitration administered by the American Arbitration Association (“AAA“) under its Consumer Arbitration Rules, except that either party may bring an individual claim in small-claims court if it qualifies.
The arbitration will take place in Miami-Dade County, Florida (or, at your election, by phone or video). The arbitrator’s decision will be final and may be entered as a judgment in any court of competent jurisdiction.
12.4 Class-Action Waiver
You and Real Hodge Group agree that each may bring claims against the other only on an individual basis and not as a plaintiff or class member in any class, consolidated, or representative action. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
12.5 Opt-Out
You can opt out of the arbitration agreement and class-action waiver by sending written notice to info@realhodge.com within 30 days of first using the Site. The notice must include your name, address, and a clear statement that you wish to opt out.
12.6 Exceptions
This Section 12 does not apply to claims to enforce intellectual-property rights, claims for injunctive relief to prevent unauthorized use of the Site, or any claim that cannot be arbitrated under applicable law.
13. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last Updated” date at the top. If we make material changes, we will provide additional notice (for example, by email or a prominent Site notice). Your continued use of the Site after the changes take effect means you accept the updated Terms.
14. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and any other policies referenced here, are the entire agreement between you and Real Hodge Group regarding the Site.
- Severability. If any provision is found unenforceable, the remaining provisions stay in effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
- No agency. No partnership, joint venture, employment, or agency relationship is created by these Terms.
